This page provides information about us and the legal terms and conditions on which we will supply any of the products listed on our website to you.

By ordering any products through our website, you agree to be bound by these terms which will form part of a legally binding agreement between us.

3. Definitions

You the Customer: a person or company buying Tameside Distillery products.
Contract: an agreement by You to purchase products in accordance with our Terms & Conditions.
Consumer: a private person buying Products for private use.
Trade: a business buying Products to resell.
Tameside Distillery (us, our): short for "Tameside Distillery Ltd" – the Product manufacturer as identified on your invoice.
Order Confirmation: acknowledgement of Product ordered by you, sent by Tameside Distillery by e‑mail.
Price: stated in Order Confirmation.
Product: as described in Order Confirmation.

4. Application

This Agreement applies to this sale and all statements made by Tameside Distillery in brochures, price lists, adverts, quotations, on the internet or verbally.

Variations to this Agreement must be made by Tameside Distillery in writing. Any other Terms, Conditions or Purchase Orders are excluded.

Placing your order means acceptance of this Agreement. Tameside Distillery may change this Agreement at its choosing.

5. Orders

Orders are accepted by e‑mail or at our website, but are only binding when accepted by Tameside Distillery and Tameside Distillery sends out the Order Confirmation in writing.

Please check the Order Confirmation and notify Tameside Distillery of any mistake in writing immediately or the details stated in the Order Confirmation will apply to this Agreement.

For trade orders on credit terms, it is not possible to change the invoice company after the order has been accepted.

6. Delivery

We use the Royal Mail Tracked 48 service for deliveries outside our immediate area.

The place of delivery is stated in the Order Confirmation.

The delivery period in the Order Confirmation is approximate.

Title to Product passes on full payment.

We do deliver to addresses outside the UK mainland (England, Wales and Scotland excluding, Scottish Highlands). For example, Northern Ireland, the Isle of Man, the Isle of Wight and remote destinations such as the Scottish Highlands. These locations are outside of the Royal Mail Zone 1 and are subject to longer delivery times.

7. Acceptance

When you receive Product you must inspect it promptly and within any statutory reasonable period for inspection or rejection, if any.

After this period, you will have accepted Product.

8. Returns

You have the right to cancel your order within 60 days without giving any reason.

The cancellation period is 60 days from the day on which you or a third party indicated by you receives the Product.

This only applies to products which have been purchased directly from us.

The Product can be returned unopened or opened with up to 50% of the bottle consumed.

You have to bear the cost of returning the Product.

You can cancel the contract by visiting the Return Item page.

We will then confirm the purchase was made directly with us and provide return instructions.

Upon receiving and inspecting the Product, we will reimburse all payments received from you for the Product, at the original purchase price as detailed in the Order Confirmation, including the delivery fee.

We will process the refund to the same card you used to originally purchase the Product. We cannot refund to a different card.

Alternatively, you can exchange the Product for another Product of the same value. In this case, the exchanged product cannot be returned.

9. Liability

Tameside Distillery does not accept liability for:

  1. Indirect or consequential loss
  2. Loss of business profits, salary, revenue, savings
  3. Damage remedied by Tameside Distillery within reasonable time

10. Force Majeure

Tameside Distillery is not liable for delays in performance (incl. delivery or service) caused by circumstances beyond its reasonable control and will be entitled to a time extension for performance; examples include strikes, supplier / transport / production problems, exchange fluctuations, governmental or regulatory action and natural disasters. If this lasts more than 2 months, this Agreement may be terminated by either party without compensation.

11. Confidentiality

Each party must treat all information received from the other marked "confidential" or reasonably obvious to be confidential as it would treat its own confidential information.

12. Termination

Tameside Distillery may terminate this Agreement with written notice if you fail to pay on time and within 14 days of written notice.

Either party may terminate if the other commits a material or persistent breach of this Agreement and fails to remedy this within 30 days of written notice from the other or becomes insolvent or is unable to pay debts as they fall due.

13. Your Obligations as a Customer

You are responsible for:

  1. Your own choice of Product and its suitability for purpose
  2. Your telephone & postal charges in contacting Tameside Distillery, if any

14. Age Restrictions

In the UK it is illegal for:

  1. any person under the age of 18 to buy (or to attempt to buy) alcohol for themselves or for any other person under the age of 18; and
  2. an adult to buy (or to attempt to buy) alcohol for any person under the age of 18.

You may only purchase an alcoholic Product from us if you are:

  1. at least 18 years old;
  2. not buying that Product for any person or persons under the age of 18; and
  3. of legal age to purchase alcohol both in the country where you place the order and the destination country.

You must check with the local authorities in the country where you place the order and the destination country to ensure that you will not be breaking any law or regulation by ordering alcohol from us. By placing an order to purchase a Product, you promise to us that it is lawful for you to order the relevant Product in the country where you place the order and for the recipient to receive the relevant Product in the destination country. If you breach this promise we may end the Contract and charge you reasonable compensation for the net costs which we incur.

Our local authority requires that we operate the "Challenge 25" policy when delivering direct to consumers.

15. Data Protection

Your data will be held and/or transferred in accordance with the General Data Protection Regulation (GDPR) regulation in EU law.

16. Privacy Policy

Our Privacy Policy is available upon request or from the Privacy Policy page.

17. Jurisdiction

English law and the exclusive court jurisdiction of the English courts will apply to this Agreement. The Vienna Convention on Contracts for the International Sale of Goods is excluded.

18. Miscellaneous

If any part of the Agreement is found to be invalid or unenforceable by a court, the rest is unaffected. Tameside Distillery may subcontract its obligations to a competent third party. Otherwise, neither party may assign or transfer any obligations or rights. All notices must be in writing (by hand, e‑mail or 1st class post deemed delivered 48 hours after posting) and sent to a legal officer of either party.
